Agreement to Terms
By accessing or using LovePuzzle ("the Service"), operated by LovePuzzle ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
Description of Service
LovePuzzle provides a platform for creating personalized digital puzzle experiences. Users can create custom puzzles including word games, memory matching games, and crosswords, which can be shared via custom subdomains and QR codes.
User Accounts
To use the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate and complete
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized access or use of your account
You must be at least 13 years old to create an account.
Payment and Refunds
Pricing
The Service is offered for a one-time payment of $19 USD per puzzle. All fees are in U.S. dollars unless otherwise stated.
Payment Processing
Payments are processed through secure third-party payment processors. By making a purchase, you agree to their terms of service and privacy policies.
No Refund Policy
ALL SALES ARE FINAL. NO REFUNDS.
Due to the digital nature of our products and the instant access provided upon purchase, we do not offer refunds, returns, or exchanges under any circumstances. Once you complete your purchase and receive access to create your puzzle, the transaction is final. Please ensure you understand the product before purchasing.
User Content
Your Responsibility
You retain ownership of all content you upload, including photos, text, and puzzle configurations ("User Content"). By uploading User Content, you represent and warrant that:
- You own or have the necessary rights to the content
- The content does not violate any third-party rights
- The content does not violate any laws or regulations
- The content is not harmful, offensive, or inappropriate
License to Use
By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your content solely for the purpose of providing the Service.
Content Removal
We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.
Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose or in violation of any laws
- Upload content that infringes on intellectual property rights
- Upload harmful, threatening, abusive, harassing, or offensive content
- Upload content containing malware, viruses, or malicious code
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers
- Use automated systems or bots to access the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell or redistribute the Service without authorization
- Impersonate any person or entity or misrepresent your affiliation
Intellectual Property
The Service, including its design, code, features, and content (excluding User Content), is owned by LovePuzzle and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.
Service Availability
"As Is" Provision
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOVEPUZZLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months prior to the event giving rise to the liability.
Indemnification
You agree to indemnify, defend, and hold harmless LovePuzzle, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with:
- Your access to or use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any third-party rights
Account Termination
We reserve the right to:
- Suspend or terminate your account at any time for any reason
- Refuse service to anyone for any reason at any time
- Remove or disable access to any User Content
Upon termination, your right to use the Service will immediately cease. Termination does not entitle you to any refund.
Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page with an updated "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
Dispute Resolution
Informal Resolution
Before filing a formal dispute, you agree to first contact us at support@lovepuzzle.com to seek an informal resolution.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Arbitration
Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and LovePuzzle regarding the Service and supersede all prior agreements.
